Platform Role
- Constralink acts only as a digital platform that helps employers and tradespeople connect for work-related opportunities.
- Constralink is not a party to any employment, contracting, subcontracting, compensation, or project arrangement formed between users.
- Any agreement entered into between an employer and a tradesperson is solely between those parties unless expressly stated otherwise in a separate written agreement with Constralink.
Eligibility
- You must be at least 18 years old to create an account, use the platform, or enter into any transaction or communication through Constralink.
- If you use the platform on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms of Use.
User Accounts and Profile Information
- Users are responsible for maintaining accurate, current, and complete profile, qualification, certification, and availability information.
- Each user is responsible for safeguarding login credentials and all activities that occur under their account.
- Constralink may suspend, restrict, or remove accounts that contain false, misleading, fraudulent, or unauthorized information.
Acceptable Conduct
- Users must act professionally in all chats, messages, reviews, ratings, and other interactions conducted through the platform.
- Harassment, threats, discriminatory language, profanity, abusive conduct, or other offensive behavior are prohibited.
- Users may not post false reviews, defamatory statements, spam, or content intended to damage another user's reputation unfairly.
Disputes Between Users
- Constralink does not manage or resolve personal disputes, payment disagreements, work performance claims, workplace incidents, or other conflicts arising directly between employers and tradespeople.
- Any personal matters, off-platform arrangements, side agreements, and obligations made outside the app are not covered by Constralink.
- Users remain solely responsible for independently evaluating the suitability, qualifications, conduct, and contractual commitments of the other party.
Content, Reviews, and Communications
- Users retain responsibility for the content they upload, publish, send, or communicate through Constralink.
- By using the platform, users grant Constralink a limited right to host, process, display, and moderate submitted content as necessary to operate, secure, and improve the service.
- Constralink may remove or restrict content that violates these Terms of Use, applicable law, or the rights and safety of other users.
Breach of Contract and Violations
- If a user breaches these Terms of Use or any related agreement with Constralink, Constralink may investigate the matter and take appropriate action, including warnings, suspension, account restriction, content removal, or termination.
- Where a breach causes harm, risk, legal exposure, or reputational damage, Constralink reserves the right to pursue remedies available under law or contract.
- A breach of contract between an employer and a tradesperson remains the responsibility of those parties unless Constralink is expressly identified as a contracting party in a separate written agreement.
Limitation of Responsibility
- Constralink does not guarantee job placement, hiring decisions, project outcomes, payment, worker conduct, employer conduct, or the completion of any work arrangement made through the platform.
- To the fullest extent permitted by law, Constralink is not responsible for indirect, incidental, consequential, or special damages arising from user relationships or transactions.
- Users are encouraged to document their own agreements, verify credentials independently, and obtain legal advice where appropriate.
